Minutes of Commission meeting held on July 10, 2012.
7:10 p.m. The meeting was called to order. Present were: Nathan Gumlaw, Chairperson, Patricia Caron, Marianne Martone and James Wettlaufer. Absent: Marcia Beal, Neal Byrne and Mary Lovett.

We received a check for the filing fee for an Abbreviated Notice of Intent from Kathleen Hunt and William Libretto in compliance with the Enforcement Order of 4-18-2012.
The scheduled Public Hearing of a Request for Determination for Chris Wszolek of 95 May Brook Rd., regarding theAeration System for “The Cove” at the intersection of Sandy Beach Rd. and May Brook Rd. was held. Sparky Lamontagne of 109 Sandy Beach Rd. was the only abutter that came. Following discussion Nathan Gumlaw made a motion to accept the project with a Negative Determination meaning that no Notice of Intent is required. Seconded by James Wettlaufer. All were in favor of closing the hearing at 7:25 p.m.
7:25 p.m. Lindsey Wellman of 5 Wall St., Map R-11-B-5 requested permission, as suggested by an arborist, to remove a dying deciduous tree ten (10) feet from the lake. Nathan Gumlaw signed a Procedure Sheet with the condition “leave the roots”.
7:30 p.m. The scheduled Public Hearing of a Notice of Intent for Robin and Donald Wilson to renovate their home at 57 Mashapaug Rd. was held. No abutters came. The Conservation Commission and the Wilsons received from the Mass. DEP a “Proposed Template for Evaluation of 10.58 (5) Redevelopment Projects” because their property abuts not only the lake but also Stevens Brook. Most of their project is acceptable except for a 6 x 12 closet that will be constructed on 3 concrete piers. They were instructed on how to improve on their plot plan, write a narrative indicating their erosion controls and complete No. 3 of the “Proposed Template”. Motion was made by James Wettlaufer to continue the hearing until 7-24-2012 at 7:30 p.m. Seconded by Nathan Gumlaw and
approved by all.
8:15 p.m. The scheduled Public Hearing of a Request for Determination for the Highway Department to clean-up the overgrowth at the spillway at the dam was held. No abutters came. The Highway Department requests that the woody vegetative growth be removed at the spillway twice annually as recommended by Fuss & O’Neill. Following discussion James Wettlaufer made a motion to accept the project with a Negative Determination meaning that no Notice of Intent is required. Seconded by Nathan Gumlaw. All were in favor of closing the hearing at 8:20 p.m.
8:20 p.m. The continued scheduled Public Hearing of a Notice of Intent for Milton and Patricia Natusch of 19 Lakeridge Dr. to repair a septic system was held. No abutters came. Mark Farrell of Green Hill Engineering presented the project. Following discussion, Marianne Martone made a motion to accept the project. Seconded by Nathan Gumlaw. All were in favor of closing the hearing at 8:25 p.m.
8:30 p.m. Kathleen Hunt and Michael Ford of 225 Mashapaug Rd. and Tracy and William Libretto of 221 Mashapaug Rd. questioned whether their Abbreviated Notice of Intent was in compliance with the Enforcement Order of 4-18-2012. We thought so and their Hearing is scheduled for 7-24-2012 at 8:00 p.m.
8:55 p.m. Members signed the Order of Conditions for Carlo J. DiLizia of 25 Candlewood Dr., DEP File #184-0278 and the Determination of Applicability for Chris Wszolek of 95 May Brook Rd., and the Highway Dept.
9:00 p.m. Nathan Gumlaw reported that he sent a letter to the property owners of 90 May Brook Rd. requesting that they cease cutting the trees near Maybrook and attend the HCC meeting held tonight to explain their actions. They did not attend nor respond in any way.
The meeting was adjourned at 9:05 p.m.
